SMS Terms and conditions

Please read these SMS Terms & Conditions (the “SMS Terms”) carefully. By enrolling or otherwise agreeing to receive text messages from or on behalf of Pizaz Events®, you agree to these SMS Terms, as well as Pizaz Events® Terms of Use. To the extent of any inconsistency, the SMS Terms in this document will apply to our text messaging programs.

By providing a mobile phone number and opting-in for automated text messages, you represent and warrant that you are legally authorized to opt-in for automated text messages to the phone number you provide, and expressly consent to receive recurring text messages that may be sent. You agree to promptly notify us if your phone number changes. You grant permission for automated text messages to be sent to the mobile phone number you provide until you opt-out, which you may do at any time.  You may receive a confirmation message at sign-up, in which case you may need to reply as instructed to complete your registration. You consent to the use of an electronic record to document your opt-in. You agree that any information you submitted to Pizaz Events® and/or that is collected during your participation in the text messaging may be used and handled as described in Pizaz Events® Privacy Policy.

You are required to opt-in for text alerts in order to maximize service benefits from Pizaz Events® and that you can opt-out via your mobile phone when you choose.  If you no longer want to receive text messages from us, and wish to opt-out of receiving text messages, you agree that your remedy is to end text message enrollment in the applicable texting program(s). This may be accomplished by either updating your Pizaz Events® application profile settings for text messaging, or by replying STOP to any prior text message you have received from us. Either we, or the carrier may send you a text message to confirm that you have been unsubscribed.

You may incur messaging rate charges or other fees, rates, charges and/or taxes from your mobile provider, so be sure to check with your wireless phone carrier for your plan details. By providing your consent to receive recurring text messages, you approve any such charges from your mobile carrier. Charges for text messages or data usage may appear on your mobile phone bill or be deducted from your prepaid balance by your mobile carrier. 

You understand that your mobile phone number you provide will be kept confidential and will only be disclosed as permitted under state and federal law.
We do not guarantee the successful delivery of text messages by your wireless provider. Messages sent by text may not be delivered if the mobile device is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of wireless carriers may interfere with message delivery, including the terrain, proximity to buildings, foliage, weather, and the recipient’s equipment. We will not be liable for losses or damages arising from (a) non-delivery, delayed delivery, or misdirected delivery of a text message; (b) inaccurate or incomplete content in a text message; or (c) use or reliance on the content of any text message for any purpose.
You agree that under no circumstances will Pizaz Events® be liable to you for any direct or indirect, incidental, consequential, special, exemplary, statutory or punitive damages arising out of or related to any text messages sent to you.

You agree that these terms and any dispute, controversy, or claim arising out of or related to these terms, or any transaction contemplated thereby, shall be governed by the laws of the State of Texas. You acknowledge that you have read or will read the Pizaz Events® Terms of Use and Privacy Policy, for all related and relevant policies.

Any information you submit to Pizaz Events® will be handled in accordance with our privacy policy and other applicable policies, laws, and regulations.

These SMS Terms may be revised, modified, or amended by Pizaz Events® at any time without prior notice and any such revision, modification, or amendment shall take effect when posted to our website. By continuing to be enrolled in any Pizaz Events® text messaging program you agree to any changes. We may also notify you by other means, such as sending a text message to the number you used to sign-up for our service or using other contact information we may have, such as email.
